This case revolves around an alleged breach of an oral agreement granting FOX the exclusive use of the title, “Queen of the Flat Tops,” for a film. Fox wanted to use the “Queen of the Flat Tops” title for a war picture originally called Wing and a Prayer. FOX attempted to purchase only the title to the novel Queen of the Flat Tops (and not the literary content), but the author canceled the deal after an oral agreement.
