This action arises out of Defendant’s attempt to trade on the cult hit EVIL DEAD movie series and other licensed entertainments by using the name and mark EVIL DEAD as or as part of a title for a motion picture, and in connection with the promotion, development and production of such motion picture, which use violates Plaintiffs rights in its EVIL DEAD trademark in connection with identical and/or highly related goods and services.
Defendant Award Pictures, LLC is using and attempting to market motion pictures under the names EVIL DEAD 4: Consequences and EVIL DEAD: Genesis of the Necronomicon.
Judgment: The court enters judgment against the defendants.
