International Media Films, Inc., the purported owner of the copyright to Federico Fellini’s classic film La Dolce Vita, alleges copyright infringement and related claims against the defendants Lucas Entertainment, Inc., Lucas Distribution, Inc., and Andrei Treivas Bregman, known as Michael Lucas.

IMF maintains that its copyright is violated by the defendants’ two-part pornographic film Michael Lucas’ La Dolce Vita. IMF brings claims for false designation of origin and dilution by tarnishment, trademark infringement, injury to business reputation, dilution, and unfair competition in violation of New York General Business Law and copyright infringement.

The defendants counterclaim for cancellation of the plaintiff’s copyright registration, alleging that the plaintiff does not have rights to the copyrighted film.

Judgment: The defendants’ motion for summary judgment is granted. The plaintiff’s trademark claims and copyright claims are dismissed.
