Plaintiff’s claim the copyright of their song “She Can’t Stand It” was infringed through the use of the song “On Our Own” which was written by defendants, Antonio Reid and Kenny Edmonds. This song was subsequently used as the theme song in “GHOSTBUSTERS II” performed by Bobby Brown. Columbia promptly denied the charge of copyright infringement.

Judgment: Although Moore has established a reasonable possibility that Reid and Edmonds had an opportunity to copy his work, he has not demonstrated a substantial similarity between “She Can’t Stand It” and “On Our Own.” Accordingly, we affirm the district court’s decision to grant the defendants’ request for summary judgment.
