The Complaint alleges that during 1991 and 1992, Plaintiff “conceived of an idea for a theatrical motion picture and authored a screenplay based upon that idea entitled ‘Doubletime’ and claims that the film Frequency stole protective elements from the screenplay.

Judgment: the Court DENIES defendants’ motion to dismiss plaintiff’s second cause of action for violation of the Lanham Act and GRANTS the motion to dismiss with prejudice as to plaintiff’s third cause of action for breach of implied-in-fact contract.
